CooperSurgical IVF Solution Explained

CooperSurgical produces a nutrient-rich culture media solution that helps fertilized eggs develop into embryos for an IVF procedure. IVF is a type of assisted reproductive technology in which eggs are extracted from a woman and fertilized in a lab with sperm to create an embryo. Before the embryo is transplanted to the uterus, it is immersed in the culture media solution composed of magnesium, carbohydrates (pyruvate, lactate, and glucose), and amino acids during fertilization to assist in its development.

CooperSurgical IVF Solution Recalls, Defects, and Affected Embryos

A recall of this solution issued on December 13, 2023, instructed customers to quarantine the affected product until they could arrange their return. Clinics worldwide used this product throughout November and December of 2023; the number of affected customers is unknown. However, experts estimate it could be thousands.

Families around the US have filed eight lawsuits as of February 2024. More than 100 embryos bathed in the defective product known as culture media were lost. The lawsuits claim that the solution lacked an essential magnesium nutrient, harshly affecting the embryos' development.

The eight lawsuits all claim similar events: couples who spent years and significant amounts of money to conceive learned they had created healthy embryos around Thanksgiving. By Christmas time, the embryos had stopped growing. The first lawsuit involved a couple who claimed the defective media destroyed 34 embryos.

The FDA posted a recall notice on February 14, 2024, stating that nearly 1,000 bottles of the defective product were affected, approximately half of which were purchased by clinics in the US. It is unclear how many bottles of the defective product were opened before the recall in December.

During our discussion, we'll seek to understand your situation as clearly as possible. That means asking questions. If you don't have all the answers, that's OK. This moment is a traumatic time in your life. But the more you tell us, the better we can understand your situation.
