Have you suffered property damage or loss as a result of a fire, weather related event such as a storm or hurricane, or other catastrophic property loss? Have you recently filed a claim for damage under your homeowners, business, or commercial property insurance policy only to be told by the insurance company that your claim is not covered or has been limited?  Have you felt that you weren’t treated fairly?  Maybe you felt that the insurance company wrongfully denied your claim, didn’t consider all damages or losses, made you a low-ball offer, or otherwise seemed to act in their own best interest instead of yours?  If so, we may be able to help.

Has Your Insurance Claim Been Denied or Improperly Limited?

You bought insurance to protect yourself against these unexpected risks.  If you’ve paid your premiums, you have the right to the benefits of your insurance policy when you file a valid claim. Unfortunately, sometimes insurance companies wrongfully deny claims, improperly limit claims, or unreasonably delay the handling and settlement of claims.

Has Your Insurance Company Acted in Bad Faith?

How do you know if your claim has been, or currently is being, handled fairly and properly?  If you have experienced any of the following conduct by the insurance company, during the handling of your claim, you may be the victim of an unfair claim settlement or compromise practice by the insurance company:

  • Failing to acknowledge and respond promptly regarding your claim or your questions about the claim
  • Failing to confirm or deny coverage of a claim within a reasonable time after proof of loss has been submitted
  • Attempting to settle your claim for less than a reasonable amount
  • Delaying investigation of your claim by providing multiple forms requesting the same or substantially similar information
  • Failing to provide an explanation for the denial of your claim or the reason for a seemingly low-ball offer

If your insurance company has acted in bad faith in the handling of your claim, you have rights.  In addition to paying the full value of your claim you may be entitled to an award of interest on your claim from the date a valid claim was made in an amount equal to the prime interest rate plus an additional 3%; an award of punitive damage to punish the insurance company for their wrongful conduct; and/or an award of costs and attorneys fee against the insurer.
