Rear-Facing Car Seat

Law states no preference.

Car Seat

Children 3 years and younger must be in a proper safety seat.

Booster Seat

Children ages 4 through 7 must be in a booster seat or child restraint.

Seat Belt

  • All passengers must be restrained by a safety belt.
  • Children ages 4 to 7 can use a safety belt if they are over 4'9".
  • Children ages 4 to 7 and who weigh at least 40 pounds can use a lap-only safety belt in the back seat if there are no lap/shoulder belts available.

Seating Position

Law states no preference.

Fines & Penalties

  • First Offense: Maximum penalty is a $100 fine, required attendance at child restraint safety class, $50 drivers education assessment fee, and $20 in surcharges.
  • Second Offense: Miniumum penalty is a $100 fine. Maximum penalty is a $200 fine, a $50 drivers education fee, and $20 in surcharges.
  • Third Offense: Minimum penalty is a $200 fine. Maximum penalty is a $500 fine, a $50 drivers education fee, and $20 in surcharges.
  • Seat Belt Violation Fines: $45 per violation plus $20 in surcharges
