Delaware Car Seat and Booster Seat Laws

Car Seat

Children under age 7 who weigh less than 66 pounds must be in a proper safety seat.

Booster Seat

Children under age 7 who weigh less than 66 pounds must be in a proper safety seat.

Seat Belt

  • Children ages 8 through 15 must wear a safety belt.
  • Children who weigh more than 66 pounds can wear a safety belt.

Seating Position

Children under 65 inches or 12 years of age may not ride in the front passenger seat of any vehicle with a passengar side airbag (unless the airbag is specifically designed for children or small adults) unless no other seat is available in the vehicle.

Fines & Penalties

Maximum fine for first offense is $25.
