Tragic Limo Crash From a Legal Perspective
SCHOHARIE, NY, October 9, 2018 — A horrible tragedy occurred on Saturday when a stretch limousine carrying 17 birthday party guests crashed in upstate New York, killing everyone inside, including the driver. Two pedestrians were also hit and killed, bringing the total number of casualties to 20. The limo ran through a stop sign at an intersection previously reported as dangerous and struck a parked SUV. Reports indicate that problems with the limousine company, Prestige Limousine, loomed before the limo even got onto the road.
Early investigations have questioned the amount of seatbelts available in the vehicle; it’s unclear if any of the passengers were wearing them at the time of the crash. The vehicle itself was a 2001 Ford Excursion that had been converted to a stretch limousine, a conversion that experts say compromised the structural integrity of the vehicle. Reports also say that the limo had recently failed inspection and should never have been on the road and that the driver of the limo wasn’t properly licensed.
Insurance Considerations to Protect Yourself and Family
It’s unlikely that the small company will have adequate insurance to compensate the families of those who were wrongfully killed, making a heartbreaking situation even worse.
When it comes to vehicle accidents that occur when someone else is driving and at-fault, it’s critical to have adequate insurance coverage should you or a loved one suffer injuries. The importance of Underinsured Motorist Coverage (UIM) and Uninsured Motorist Coverage (UM) can’t be emphasized enough. This relatively inexpensive coverage protects you if you’re the driver, a passenger, a pedestrian, or the victim of a hit-and-run. You’d be surprised at how many uninsured and underinsured drivers are on the road.
In this particular situation, it’s likely the limo company does not have the coverage needed to fairly compensate the victims’ families. Twenty causalities could mean 20 claims against the limo company – even a million dollar policy can’t make a dent.
There is no sum that could ever make things right in a tragedy like this. But it's critical to plan in advance to protect yourself and your family by purchasing UM and UIM.
