What type of lost wages compensation can you receive?

The amount of your lost wages payment depends upon your level of disability.

Total Disability

Pennsylvania work comp allows you to collect two-thirds of your pre-injury gross weekly wages. However, the maximum work comp payment allowed is set each year. In 2009, that maximum has been set at up to $836 weekly.

Partial Disability

You may receive partial disability if you return to a light duty assignment that pays less than your pre-injury position. Pennsylvania work comp will pay two-thirds of the difference in salary up to a maximum of 500 weeks, or 9.5 years.

  • Lost wages payments can be reduced if you have other sources of income such as social security benefits, a pension, severance pay, unemployment compensation, or other payments.
  • You will never receive a "cost of living" increase under Pennsylvania's current work comp system. You will collect the same payment – with no increase – for as long as your payments continue. This is one reason why some people chose a lump sum settlement.
