Merck Ordered to Pay $9 Million

Merck has been ordered to pay $9 million in punitive damages to John McDarby, a former Vioxx patient and heart attack survivor. This is on top of the $4.5 million already awarded for compensatory damages. The punitive damages were awarded by a New Jersey jury who felt Merck misrepresented Vioxx to federal regulators.

Merck’s counsel plans on appealing both the punitive and compensatory damages, claiming they provided the Food and Drug Administration (FDA) with the appropriate information they were required to disclose. They still maintain their argument that Vioxx did not lead to any patients’ deaths.

Merck faces over 10,000 lawsuits from people who hold Vioxx responsible for their heart attacks.
