Fourth Vioxx Trial Nears for Merck

The fourth Vioxx battle for Merck & Co. is slated to begin in late January. The case involves a 71-yr-old man, Leonel Garza, who died after taking Vioxx for one month.
The attorneys acting on behalf of Mr. Garza’s family believe this is a “very strong” case despite his various cardiovascular complications and history of heart problems. Prior to the heart attack that killed Mr. Garza in 2001, he underwent an operation to open his clogged arteries. A scan taken a few weeks before his heart attack showed normal blood flow to the area where Mr. Garza once had clots. Doctors recorded Mr. Garza’s condition as “stable” in his medical files. Merck maintains that Mr. Garza’s short term use of Vioxx could not have been the cause of his deadly heart attack.
Vioxx was taken off the market in 2004 after it was associated with increases in heart-attack risks.
