Pennsylvania Requires Booster Seats for Children Until Age 8
In an effort to keep our children safe while riding in motor vehicles, the Pennsylvania legislature passed House Bill 2410. This Bill addresses work zone and truck safety issues along with adding a booster seat requirement to the original bill. This part of the Bill can be found under §4581 RESTRAINT SYSTEMS.
Under HB 2410 §4581 RESTRAINT SYSTEMS, booster seats are now required under Pennsylvania law for children ages 4 to 8. If violated, this is a secondary offense. The driver can only be cited if there was a moving violation, such as speeding or failure to stop at a stop sign. The fine for this offense increases to $100 from the original $25. The fine money will continue to go into a fund to purchase car seats for programs that distribute car seats throughout Pennsylvania.
It is still the law in Pennsylvania that children under 4 years of age will be required to use a child restraint (e.g. car seat). If violated, this is a primary offense.
Additionally, the law still requires all drivers of passenger vehicles to securely and properly restrain any front seat passengers ages 8 to 18 by use of seat belts.
