New Mexico Car Seat and Booster Seat Laws

Rear-Facing Car Seat

Children less than 1 year of age must be properly restrained in a rear-facing child safety seat in the back seat when possible.

Car Seat

Children ages 1 through 4 years or who weigh less than 40 pounds must be in a child safety seat.

Booster Seat

  • Children ages 1 through 4 years or who weigh less than 40 pounds must be in a child safety seat.
  • Children ages 5 through 6 or who weigh less than 60 pounds must be in a booster seat.

Seat Belt

Children ages 7 through 17 must use a seat belt.

Seating Position

Children less than 1 year of age must be properly restrained in a rear-facing child safety seat in the back seat when possible.
